The agreement between you and Evigenics for using evigenics.com: the DNA report, the peptide directory, the journal and your account. What we do with what you give us is in the privacy notice, which is part of these terms.
Who we are
Evigenics (evigenics.com) is operated by TwoEleven LLC, a Delaware limited liability company, in the United States (“Evigenics”, “we”). You reach us through the contact form. By making an account, uploading a file, or using the site, you agree to these terms. If you do not, please do not use the site.
What Evigenics is, and is not
For informational and educational use only. Not medical advice, a diagnosis, or a substitute for clinical genetic testing. Discuss your results with a qualified provider.
Evigenics is an educational service. It reads genetic data you already own and explains what the published research associates with it, in plain language. It is not a diagnostic test, not a clinical laboratory, not a prescription, not genetic counselling and not a substitute for a clinician who knows you. It does not review your situation and recommends no treatment, no supplement and no dose. Nothing here tells you to start, stop or change anything. Decisions about your health belong with a qualified professional, and a report or a directory page is something to take to that conversation rather than to act on alone. If you think you have a medical emergency, contact emergency services.
Whether a finding means anything for you, and what to do about it, is for you and your clinician to decide. No lawyer and no clinician has reviewed these terms.
Who may use it
You must be 18 or older and able to make a binding contract where you live. Upload genetic data only if it is yours, or if you are the parent or legal guardian of the person it belongs to, or if you have that person's clear permission. Do not upload anyone else's data for any other reason. Evigenics is not for use where the law requires a report from a licensed clinical laboratory, and it is not for deciding anyone's care, employment, insurance or eligibility for anything.
Your account
You are responsible for keeping your sign-in details to yourself and for what happens under your account: anyone who can read your mailbox can reach it. An account is for one person. Tell us promptly, through the contact form, if you believe someone else has reached it.
Your files, your results and your reports
Your DNA file, the lab reports you upload and the reports made from them stay yours. You give us permission to keep, read and process them only to produce, show and keep the reports you ask for, and for nothing else. What we read, what we keep, how it is protected and how to delete it are in the privacy notice. You promise you have the right to give us what you give us.
The peptide directory
The directory describes peptides the human body makes. Each page is written by hand from the published literature and lists the sources behind it, so you can read them yourself. Where a page names a medicine, it does so as a matter of fact: what the medicine is, where it is approved, what it is approved to treat, and what the trials found. Naming a medicine is not a recommendation of it, and no page recommends anything. Evigenics sells no peptide and supplies no peptide.
Research moves. An approval, a trial result or a dose may have changed since a page was written, and a page may contain a mistake. We correct what we find and what readers tell us about, but we cannot promise that every line is current or complete. Do not rely on the directory for a clinical decision.
Using it fairly
Please do not copy the site wholesale or scrape it for a competing service, present our material as your own or as medical advice, resell access, attempt to reach other people's accounts or data, probe, overload or get around the site's limits, or use it in a way that breaks the law. You may read, print and share individual pages for your own use, and link to them freely.
No warranty
Evigenics, the reports it makes and everything on evigenics.com are provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, currency or non-infringement, or that a report, a score or a directory page is correct, complete, up to date or suitable for you.
Limit of liability
To the fullest extent the law allows, Evigenics is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from Evigenics or from anything you read here, and Evigenics' total liability for all claims about Evigenics is limited to one hundred U.S. dollars (US$100). These limits do not apply to liability for fraud, gross negligence or willful misconduct, or to any liability that the law does not allow to be limited.
Your responsibility
You will defend and indemnify Evigenics against claims by others that arise from what you put into Evigenics or from your breach of these terms, except to the extent a claim arises from Evigenics' own negligence or misconduct.
Suspending, ending and closing
You can stop using the site at any time, and delete your files, your reports and your account yourself in Account. We may suspend or close an account that breaks these terms or puts other people's data at risk, and we would explain why where we can. If Evigenics is to stop, we email account holders at least 30 days before, and you can download your files and reports until then.
Disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute about them goes to the state and federal courts located in the State of Delaware, and you and Evigenics agree to those courts' jurisdiction. Either of us may instead bring a claim in small-claims court where it qualifies. There is no arbitration.
Changes to these terms
A new version of these terms is posted here with the date it takes effect. We email account holders at least 30 days before a material change applies. Continuing to use the site after a change takes effect means you accept the new terms.
Other people's work
The organ drawings in the peptide directory are provided by Servier Medical Art, licensed under CC BY 4.0. Some drawings have been converted and recoloured for this site; Servier does not endorse Evigenics. The directory cites published research, which belongs to its authors and publishers. Everything else on the site, including the Evigenics name, mark and written text, belongs to Evigenics.
The rest
These terms and the privacy notice are the whole agreement between you and Evigenics about using the site. If a part of them cannot be enforced, the rest still applies, and not enforcing a part is not a waiver of it. You may not transfer these terms; we may transfer them to whoever takes over Evigenics, and will tell you if we do.
